Grant of Easement – Tom Green County
Approximately 0.05 Acres at the Old San Angelo Fish Hatchery

I.      Executive Summary: The City of San Angelo requests an easement of approximately 0.05 acres of land for the construction and installation of a wastewater line across the San Angelo Fish Hatchery to serve the residents of San Angelo.

II.     Discussion: The San Angelo Fish Hatchery, located along the banks of the South Concho River, was constructed in 1930. It originally consisted of 34 ponds and later expanded to 40 ponds. The facility serves as an administrative office for Texas Parks and Wildlife Department (TPWD) staff located in San Angelo.

The City of San Angelo has requested a long-term easement across approximately 0.05 acres (approximately 2,085 sq. ft) to allow for the construction and placement of a wastewater pipeline, which will benefit the citizens of San Angelo. The portion of TPWD property that requires an easement for the pipeline is only a small portion of the project and is crossing land that was previously disturbed during the installation of the fishery ponds, minimizing any potential for harm to the land from the proposed easement.

III.    Recommendation: Staff recommends that the Texas Parks and Wildlife Commission adopt the following motion:

“The Texas Parks and Wildlife Commission adopts the Resolution attached as Exhibit A.”

A Resolution by the Texas Parks and Wildlife Commission Regarding the Granting of a Utility Easement Covering Approximately 0.05 Acres of Real Property in Tom Green County

Resolution

      Whereas, Texas Parks and Wildlife Department (TPWD) owns and operates the San Angelo Fish Hatchery that serves as administrative offices for TPWD staff; and,

      Whereas, the City of San Angelo is seeking to construct a sanitary sewer pipeline that will cross a portion of the fish hatchery; and,

      Whereas, the City of San Angelo requests a utility easement (Easement) across the fish hatchery property for the said sanitary sewer pipeline; and,

      Whereas, the City of San Angelo estimates this required easement is approximately 0.05 acres (approximately 2,085 sq. ft.); and,

      Whereas, the Texas Parks and Wildlife Commission (Commission) finds that as required by Texas Parks and Wildlife Code (PWC) chapter 26, notices of today’s hearing of this matter were published at least once a week for three consecutive weeks in a newspaper of general circulation which is published at least six days a week in the communities nearest to the fish hatchery in which such newspapers are published (San Angelo Standard-Times in Tom Green County), with the last day of publication being not less than one week or more than two weeks before the date of today’s hearing; and,

      Whereas, the Commission finds, in accordance with PWC chapter 26, that (1) there is no feasible and prudent alternative to the use or taking of such land (Easement); (2) the program or project that requires the Easement includes all reasonable planning to minimize harm to the land; and,

      Whereas, the Commission finds that the grant of an Easement subject to conditions that will minimize harm of the Easement to the fish hatchery is in accordance with PWC section 11.301; and,

      Now, therefore, the Commission authorizes the Executive Director to take all necessary steps to negotiate terms and conditions under which an Easement may be granted, and to grant an Easement to the City of San Angelo for the purposes and subject to the conditions described herein and in the motion approving this Resolution.
